An attempt by the candidate of the Action
Congress of Nigeria (APC) Senator Chris Ngige to reverse the decision of the
Anambra State Election Tribunal, Awka has suffered yet another setback at the
Court of Appeal Enugu.
The lower tribunal had earlier refused to allow all
objections by counsels to be consolidated into the final address for speedy
dispensation of justice; a position that was upheld by the Court of Appeal
Enugu. Delivering judgment on the appeal No: EPT/CA/E/02/2014 Hon Justice Peter
Olabisi Ige, struck the plea of Ngige’s lawyers.
Also affected were appeals by Chike Obidigbo,
EPT/CA/E/05/2014 and EPT/CA/E/06/2014 where the Court refused to grant the
request to determine said it cannot the candidate of the All Progressives Grand
Alliance (APGA).
The panel of five appellate court judges headed by Hon
Justice Abdulkadir Jega granted seventy percent of the rulings in favour
Governor Willie Obiano in the interlocutory appeals arising from the Anambra
Election Tribunal.
The court however, said that the Tribunal can
revisit certain paragraphs concerning the issue of alleged double registration
which had been determined by an Anambra State High Court, Otuocha Division.
Already Governor Obiano’s lawyers have appealed the decision
to allow the Tribunal to revisit a matter already adjudged and determined by a
court of competent jurisdiction.
Of all the appellants Chris Ngige had already closed his case
at the Tribunal while that of Comrade Tony Nwoye’s is still pending.
