Treasonable felony against Kanu IPOB Leader: Buhari government is confused as Elders endorse Customary governmnet of Biafra
Leadership of the Customary Government of Indigenous people of Biafra yesterday frowned at the fresh charges of treasonable felony against the Leader of Radio Biafra/Indigenous People of Biafra, Nnamdi Kanu by the Federal Government.
Solicitor of the Customary Government of the Indigenous people of Biafra ,Emeka Emekesri, Esq in a chat with www.odogwublog.com , said the onus is on the federal government to prove the charges beyond all reasonable doubts.
Emekesri insisted that as a lawyer armed with the rule of law that it is not enough to accuse one of crime without evidences to prove the case.
He however insisted that ‘’ rule of law is clear and the prosecutor should prove the case beyond all reasonable doubts. So if they have a case let them prove the case because I know that nobody is above the law only when the prosecutor proves the case’’.
On his part, the Financial Adviser of the Customary Government of the Indigenous people of Biafra , Ndubuisi Anaenugwu admitted that the charges he saw was empty as according to him Federal Government is in court with the Customary Government of the Indigenous people of Biafra which Nnamdi Kanu is part of since 2012 and wondered what they want to achieve by giving him fresh charges.
Anaenugwu insisted that sequel to the court case which is at Federal High court Owerre , Federal government cannot refer to IPOB as illegal as there is nothing wrong for a group of people to demand for their freedom legitimately.
Meanwhile, the Secretary General, Supreme Council of Elders of Indigenous People of Biafra, Brig. Gene (rtd) Joe Achuzia has insisted that ‘ The Elders have accepted to correct the mistakes of the past through the instrumentality of the Customary Law.
Achuzia in a statement made available to www.odogwublog.com noted that the process to achieve the State of Biafra through the due process of law started since 2012 and that several efforts to lobby the international community have started yielding positive results, hence the commencement of Customary Government under the Nigeria Customary Law.
On is part , the Deputy Chairman of the Customary Government and former Chairman of Ohaneze Ndigbo Anambra state , Dr Dozie Ikedife towed this same line with Achuzia as he confirmed that the action of the Supreme Council Of Elders is line with the law of the land and challenge anybody to question their legal authority.
According to Ikedife: ‘’ In order to ensure that the agitation by the youths for BIAFRA Independence was conducted lawfully, the Elders of the land invoked their powers under Customary Law to organize, direct, manage and control their children so that the independence struggle would follow due process of law’’.
Ikedife said that the Elders cannot be involved in illegality and advice the Federal Government of Nigeria to respect the rights of the Indigenous people everywhere in Nigeria even as he confirmed that the suit no :FHC/OW/CS/192/2013 at Federal High Court Owerri between Biafra and Nigeria has been characterized by avoidable adjournment(s).
The Chairman of the Customary Government of IPOB His Royal Majesty Rtd Justice Eze Ozobu could not be reached but a source close to him insisted the Retired Justice has always made one wish’ That Biafra be restored during his lifetime’, while the Director for Administration Engr Aniebue was filled with excitement that things are still being put in places for a legally achieved IPOB nation.
www.odogwublog.com recalls that the flag of operations by the Customary Government of Indigenous people of Biafra at Government secretariat, Enugu took place on Monday as captured in a statement by the solicitor of the Indigenous people of Biafra Emeka Emekesri, Esq.
The statement states that the Governing Council of Indigenous People of Biafra remains functional having the following principal leaders: HRM, the Honourable Justice Eze Ozobu OFR (Chairman); Dr Dozie Ikedife OON, JP (Deputy Chairman); Brig. Gen. Joe Achuzia (Secretary-General); HRM, Eze Iheanyi Nwokenna OFG, JP (Public Relations Officer), with other members of the Council are still on duty.
The statement read in part: ‘’We are happy to announce that the Customary Government of Indigenous People of Biafra has commenced operations at the Government Secretariat located at Enugu in the interim.
‘’Attached herewith are the photographs of the Secretariat. All the Ministries are located within the Complex but liaison offices shall be opened in all parts of Biafraland for easy coordination.
This is coming as Bishop on the Niger (Anglican Communion) Rt. Rev. Owen Nwokolo called on the government at all levels to listen to the people’s grievances especially the people of South Eastern Nigeria.
Bishop Nwokolo said: ``Nobody should be ignored, to enable them contribute to the society. Government should not ignore them when they are agitating for better living condition.
``We all belonged to this country, we must not all agree, we have things bordering us. Let government see to the need of the people,’’ Nwokolo said.
He said that he was optimistic that Nigeria would not be divided in spite of the numerous present challenges.
`I do not have doubt about the continued corporate existence of Nigeria in spite of the crisis all over,’’ he said.
Nwokolo, however, urged Federal Government to settle the national questions, pointing out that with dialogue and true federalism things will be better.
``God is very much interested in our affairs here on earth and that is why he sent his son Jesus Christ to save us from our sins.
``Right from the creation of the world, God had been interested in the salvation of mankind. He made light and everything so that man will benefit from his presence.
``But man although the years has always gone astray and that have been the cause of wars, conflicts and all kinds of evils bedeviling the world.
`` Let us show love and peace, let us live with one another, let us cherish one another, let accept one another, let us bear with one another in this Xmas season,’’ he said.
Kanu’s younger brother, Prince Emmanuel Kanu, had raised alarm that after the court released his elder brother unconditionally, IPOB members went to the DSS office to complete papers for his release, but that unfortunately, the DSS brought a document for Nnamdi Kanu to sign to the effect he would denounce the agitation for Biafra.
Prince Emmanuel disclosed that based on the fact that the Abuja High Court granted his brother unconditional release, Nnamdi Kanu did not sign the document and the DSS refused to release him on the pretext they were coming up with a treason charge against the IPOB leader.
Further efforts to get Mr. Kanu’s counsel, Vincent Obeta, to speak did not yield fruits.
The fresh six-count charge, Mr. Obeta said, concerns allegations of treasonable felony, maintaining an unlawful society and illegal possession of items, among others.
The charges were filed by the office of the Attorney General of the Federation, and signed by the federal Director of Public Prosecution, Mohammed Diri.
The allegations include a plot by Mr. Kanu and some persons now at large to cause crises that might force the President and Commander-in-Chief of the armed forces of Nigeria, Muhammadu Buhari, to concede certain parts of Nigeria to a purported Biafra nation.
Mr. Kanu was also alleged to have been maintaining unlawful society and retaining items belonging to IPOB, among others.
The allegations, the charges said, contain offences punishable under sections 41 (C), and 63 of the criminal code act; as well as section 47(2) (a) of the Customs and Excise ManagemenThe other two persons jointly accused in the fresh charges are Benjamin Madubugwu and David Nwawuisi.
Justice Adeniyi Ademola had, in a December 17 ruling, faulted the action of the State Security Service in detaining Mr. Kanu for over two months, without trial.
