The embattled Chairman of Orumba South Local Government Area of Anambra State, John Onyeakpa,
who received an impeachment notice last two weeks, has petitioned the Police authorities, alleging threat to his life.
The petition titled, “Threat to life of Hon Barr John C Onyeakpa,” was written and signed by his counsel, Emeka Agbapuonwu, and forwarded to the state Police Commissioner, Hosea Karma, and made available to reporters in Awka.
Dated June 10, 2015, the petition alleged that the Council chairman has been receiving threat calls and text messages on his phone for some time now, following his disagreement with his councilors.
It will be recalled that last week, 18 councilors of the local government signed an impeachment notice to the chairman over alleged misappropriation of the council’s funds.
The petition read: “it is our instruction that shortly after the assumption of office by our client the below mentioned councilors started making unbearable and unjustifiable demands from our client for the purpose of covering their campaign and election expenses.
“It is our further instruction that as a result of the inability of our client to meet with the above mentioned persons unlawful demands, they have resulted to threatening the life of our client by using strangers to make threatening phone calls.
“it is our further instruction that our client is now hiding since the 1st day of June, 2015 as he has continued to receive strange calls with hidden numbers on his cell phone, threatening to kill him, if he is seen anywhere around the local government headquarters, Umunze.
“We humbly request that you cause a high powered investigation to be conducted into this complaint with a view to getting to the root of this matter”.
Meanwhile, the Council chairman had dragged the councilors and the chief judge of the state to court over the matter.
He has equally through his counsel filed a motion exparte and motion on notice against the Chief Judge of the state, Mr. Justice Peter Umeadi, at the Aguata High.
The Chief Judge was joined with the eighteen councilors who signed the impeachment notice against the council chairman and the clerk of the council, Samuel C Okoye was equally sued as a defendant in suit No AG/32/2015.
He is seeking order of  interlocutory injunction, restraining the respondents, respondents from holding or attending meetings  for the purpose of discussing or taking decisions on the impeachment of the plaintiff , proceeding with the impeachment proceedings against him  or initiating  or taking part in any proceedings or processes  pertaining  to or connected with the issue of his impeachment  or removal from office.
In the order of interlocutory   injunction he is restraining the 20th defendan/ respondent (chief judge) from giving effect to the 1st to 19th defendant/respondents   request to appoint a seven man panel to investigate the allegation against the plaintiff  and:
“A declaration that the clandestine impeachment process imitated by the 1st to 19th defendants against the plaintiff without lawful and valid service of an impeachment notice on him is unlawful, unconstitutional , null and void and of no effect whatsoever
“An order of court setting aside the purported notice of impeachment by the defendants against the plaintiff.
