Beluchukwu Nwoye gets bail after arraignment for alleged threat to unlawful kidnap, imprisonment, malicious damage

www.odogwublog.com reports that a middle-aged man, Beluchukwu Nwoye been granted bail by an Nteje Chief Magistrate Court in Oyi Magisterial District of Anambra state, shortly after hi arraignment on a four-count charge of conspiracy, threat to unlawfully imprison and or kidnap and malicious damage.

Ruling in an oral application for bail made by the defence counsel, C. J. Asiegbu, the presiding Chief Magistrate, Mr. Ibemesi, granted him bail in the sum of N200,000 with one surety in the like sum on the ground of his ill-health.

The court however warned him to be of good behaviour throughout his trial at the High Court.

Adjourning the matter to May 3, this year, Ibemesi ordered both the court registrar and the police to transfer the case file to state Director of Public Prosecutions, DPP for further actions and bounded four witnesses over in the sum of N20,000 each.

Asiegbu had in his oral application for the bail, tendered copies of medical report and x-ray film which were issued to him from a government owned hospital where he was admitted as a result of injuries he claimed to have sustained when he was arrested by the police.

But in opposing the bail application, the police prosecution counsel, Innocent Obi, a Deputy Superintendent of Police, DSP attached to the Special Anti-Robbery Squad, SARS, argued that kidnap and unlawful imprisonment are not bailable offences and as such should not be granted bail, adding that he could even jump bail if so granted.

The defendant, according to the police prosecution, had on December 14, 2016, at Ezi-Nkwelle village, Nkwelle-Ezunaka, conspired with others now at large to commit felony to wit: threat to unlawfully imprison and or kidnap someone through telephone call and the use of armed thugs.

The prosecution also stated that the defendant and others still at large had on the same date and venue, threatened to unlawfully kidnap and or imprison one Mr. Chukwujekwu Machie or cause him harm if he did not leave a parcel of land for him.

The prosecution further stated that the defendant had on March 9, this year conspired with others at large and maliciously damaged government property by arming himself with clubs, sticks and other dangerous weapons which he used in maliciously and unlawfully damaging the windscreen of police patrol vehicle attached to SARS, Awkuzu valued at N120,000, property of Nigeria Police Force.

The offences, according to the prosecution, were contrary to Sections 495 (a), 496 (a) and 415 (1) of the Criminal Code, Cap 36, Vol. !!, Laws of Anambra State of Nigeria, 1991, as well as Section 315 (3) of the Criminal Code (Amendment) Laws of  Anambra state of Nigeria, 2011.
