Police Arraign Four including Catechists Over Illegal Possession Of Fire Arms, Robbery of 95 years old Lady Juliana Onuorah In Anambra

Umuahia, has arraigned four suspects for allegedly being in possession
of illegal fire-arms and armed robbery in Anambra state.
The four suspects included two catholic catechists at Nkpor – Idemili north local government area, but they were granted bail yesterday by presiding magistrate at Ogidi court one, H.N Obianwu.
They were arrested at Nkpor in Idemili north council area last week by the officers from the office of the Assistant Inspector General of Police (AIG) zone 9, Umuahia, where a pump action gun with ammunition were recovered.
But when they were arraigned yesterday, counsel to the suspects, CJ Asiegbu, said he was worried because there was a subsisting court order at a High court in the state on the same matter.
According to him, the order was on police not to arrest or detain the suspects, pending the determination of the matter, adding that the police flouted the court order by arresting and detaining the suspects.
He also, told the court that the same order was served on the legal department in the office of the AIG in Umuahia, as well as the complainants, Lady Juliana Onuorah and Patricia Onuorah.
Some of the four court charge against the suspects included illegal possession of fire arms, armed robbery and forceful damage of a house fence worth over five million naira (N5m) by the suspects.
The charges were, “that you Daniel Nwoye, Patrick Aguluchukwu, Solomon Igboji, and others now at large on the 9th day of February, 2016 at our Lady’s complex Nkpor in the Idemili North magisterial District did conspire amongst yourselves to commit felony to wit: unlawful possession of firearms and thereby committed an offence punishable under section 495 (A) of the criminal code Cap C36 Vol. II Revised laws of Anambra state 1991”
“That you Daniel Nwoye, Agbo Peter, Patrick Aguluchukwu, Solomon Igboji, and others now at large on the same date and place in the aforesaid magisterial district, did have in possession and under control one pump action gun without licence and thereby committed an offence punishable under section 3(1) off Robbery and firearms and special provision Act 2006 as applicable in Anambra state”
“That you Daniel Nwoye, Agbo Peter, Patrick Aguluchukwu, Solomon Igboji, and others now at large on the same date and place in the aforesaid magisterial district, did willfully and unlawfully damage a long block fence valued five million naira (N5, 000,000.00) property of Lady Juliana Onuora and Lady Patricia Onuora and thereby committed an offence punishable under section 415 of the criminal code cap 36, vol. II revised law of Anambra state 1991”
“That you Daniel Nwoye, Agbo Peter, Patrick Aguluchukwu, Solomon Igboji, and others now at large on the same date and place in the aforesaid magisterial district, did in a manner likely to cause a breach of the peace or reasonable apprehension of a breach of the peace by entering on land situate at our lady’s complex Nkpor which is in actual and peaceable possession of lady Juliana Onuora and lady Patricia Onuora and thereby committed an offense punishable under section 115 of the criminal code cap 36, vol. II revised law of Anambra state 1991”
However, the police prosecutor, Sunday Okoye, told the Court that the police had not been served the purported order brought by the defendants as being claimed by their counsel.
Okoye, described the application by the defence counsel to stay the matter pending determination at the High court, as a ploy to delay the process and to deceive the public and the court.
He insisted that the police could not have flouted the court order if it was really served on them because, they were law abiding people.
When the defence counsel applied for bail, the presiding magistrate H.N Obianwu granted it to the suspects, adding that their offence was bailable.
She therefore, granted them bail with the sum of one hundred thousand naira each (N100, 000) with one surety each, they were to deposit their three passports each with a verifiable address among others.
The matter was therefore adjourned to the 16th of March, 2016 for continuation, but the suspects were taken back to detention until the bail conditions were met.
