Ubah is set to win its first game of the 2016 Nigeria Professional
Football League which kicks off on Sunday with Giwa FC, following its
victiory to continue with its matches and progranmmes at the Federal
High Court Awka yesterday before Justice I.B Gafai.
This is following Justice Gafai ruling dismissing the order seeking to stop FC Ifeanyi Uba from playing its first match on Sunday and other activities using its stadium.
Justice Gafai in his ruling after listening to the defense and plaintiff counsels granted FC Ifeanyi Ubah’s order seeking the dismissal of the courts initial order maintaining statuesque as it amounts to abuse of court process as the same issues were before an Abuja federal High court which already gave a prohibiting and sustaining order against Gabros football club and Chief Gabriel Chukwuma from interfering with the activities of FC Ifeanyi Ubah and his stadium.
With the order, FC Ifeanyi Ubah is free to operate a football club and particpate in all the activities of the Nigeria Professional Football League and other relevant football activities within and outside the country pending the hearing and determination of the substantive suit.
Gabros International football club and its chairman Chief Gabriel Chukwuma as plaintiffs had dragged the FC Ifeanyi Ubah limited , its Chairman Dr Ifeanyi Patrick Ubah , League Management company limited and Corporate Affairs Commission as defendants before an Awka Federal High Court 2 to stop the defendants from participating in the Sunday Match and other activities of the Nigeria Professional Football League.
The judge adjourned for hearing and determination of the suit on 3rd March, 2016 for fair hearing, while withdrawing the initial preliminary objection from the defendants and admitting the new one. The judge had earleir frowned at a contradictory reportage of an order he made in the court by a newspaper sports page (The Sun) but warned he cannot be swayed as he knew the order he made and how he made it.
The spirited efforts by the plaintiff’s counsel to stop FC Ifeanyi Ubah failed woefully, as the calculated counsel of the defendants pontificated on the point of law from his 35 years experience.
The defense lead counsel , J.N.M Mbanugha , Prof of Law in his reaction to the ruling of the Judge said ‘’ Please I am tired now. I have not eaten anything since morning’ and waved our correspondent away.
But the Lead counsel to the defendants, B.A Oluyede said the Judge stated clearly he was worried that there was an attempt to put him in a collusion course with Abuja Federal High Court which barred the Gabros International owner by himself and his agents from interfering from FC Ifeanyi Ubah’s activities in the stadium pending the hearing and determination of suit before it.
He said the subject matter of the case before Abuja Federal High court was the same as the one at Awka Federal High Court and that at Nnewi Anambra stae High Court hence he raised the issue of ethical issue, adding that the plaintiffs counsel may be reported to the NJC for abuse of court processes with his multiple suits.
Meanwhile, jubilation rocked the country shortly after the court processes as members supporters club of FC Ifeanyi and players erupted in jubilation they would play their first match on Sunday. There was tension on likely outcome of the court proceedings on whether they would play or not and the supporters have been waiting patiently.
Ubah Reacting to the ruling in favour of Ifeanyi Ubah FC , the Chairman Ifeanyi Ubah supporters club, Iloka George said they are ready to cheer the team to victory this Sunday as it opens its season , praying that the club finishes top at the end of the league .
He said the team will win its first game since it has been vindicated by the court ruling on its behalf , isnsiting that the supporters club are ready for the first match to cheer the team to victory.
