Factional Governorship candidate of the All Progressive Grand Alliance ( APGA) in Abia State, Chief
Reagan Ufomba has lost the suit he filed at the Federal High Court, Umuahia, challenging the authenticity of Dr. Alex Otti’s candidacy in the April governorship election in the state.
Presiding Justice Folashade-Adejoke Olubanjo struck out the suit for lack of merit while delivering judgement on the matter yesterday in Umuahia.
Ufomba had argued that Otti had not resigned his membership of the Peoples Democratic Party, PDP, when his name was submitted by the National Chairman Chief Victor Umeh as APGA’s governorship candidate for Abia State.
He argued furtherthat Umeh was no longer the party’s National Chairman when the primary that produced Otti was held, alleging that Umeh lacked the powers to present Otti as the party’s flag bearer.
The third argument he presented to the court was that the primary election conducted by the Umeh’s leadership was illegal, having joined APGA, Umeh and the Independent National Electoral Commission in the suit.
In her judgement, the presiding judge, Justice Olubanjo observed that there was a subsisting court of Appeal decision over the leadership of APGA by Chief Umeh, stating that the issue of who is APGA’s authentic candidate is not justiciable.
Striking out the suit, Justice Olubanjo said that it lacked merit, meaning that Otti still stands as the authentic APGA Candidate in the state.
