Lawyer Insists Obiano must be jailed , and vacate seat as Governor Anambra



President of the Conference of Nigeria Registered Voters, Barrister Jezie Ekejiuba, has headed for the Court of Appeal, Enugu, in his bid to unseat Anambra State Governor, Chief Willie Obiano.

Ekejiuba, who last December 10 lost his suit lodged before Hon. Justice I.B. Gafai of the Federal High Court Awka, Anambra State, filed an appeal vide Notice of Appeal filed at the Court of Appeal, Enugu, last week Friday, January 30.
In the appeal, the human rights lawyer contended that “the judgment of the trial judge is against the weight of evidence, and he came to a wrong decision occasioning a grave miscarriage of justice.”
Ekejiuba is praying the Court of Appeal “to set aside the Ruling/Judgment of the Federal High Court of Nigeria sitting at Awka delivered by Hon. Justice Isah B. Gafai on the 10th day of December, 2014 and in its  place enter the reliefs claimed and proved as on the Appellant’s Originating summons dated and filed on November 6, 2013.”
 It would be recalled that Justice Gafai had dismissed the suit on alleged double or multiple registration resurrected by Onitsha-based Ekejiuba, seeking the disqualification of Chief Willie Obiano as the All Progressives Congress (APGA) candidate and nullification of the November 2013 governorship election that gave him victory over alleged discrepancies in his voting documents during the November 2013 election.
In the suit No.FHC/AWK/CS/269/2013, brought against Chief Obiano, Anambra State Resident Electoral Commissioner (REC), Prof. Chukwuemeka Onukogu, and Independent National Electoral Commission (INEC), the plaintiff claimed that Obiano allegedly submitted fake voter’s card in his INEC Form CF001 sworn affidavit contrary to Section 31 (1) to (6) of the Amended Electoral Act, 2010.
Justice Gafai dismissed the suit for lack of merit and inconsistency in reliefs sought.
