Court voids Anambra PDP caretaker committee

A Federal High Court sitting in Abuja has voided the caretaker committee recently constituted for the Peoples Democratic Party (PDP) in Anambra State by the national leadership of the party.

Justice Evoh Chukwu in his judgment held that the composition of the committee, during the pendency of a suit, was an affront to the court.
In addition, the judge held that the constitution of the caretaker committee contrary to the undertaking by the party’s lawyers amounted to foisting a state of helplessness on the court. A former chairman of the party in the state, Ken Emekeanyi, filed the suit. The judge dismissed the suit for being an abuse of court process.
Justice Chukwu dismissed the suit on the grounds that it amounted to an abuse of court process because there were multiple pending cases on the same issue about the leadership of the PDP in Anambra State.
Emekeanyi had by his suit, prayed the court to hold that his term of office for four years started running from 2013 when he was allowed to function, even when the election that produced him was held in 2012. The plaintiff was elected vice chairman in 2010 and assumed office of the chairman in 2013 when the former occupant, Emmanuel Nweze, resigned.
Earlier in the judgment, Justice Chukwu had rejected the argument by lawyer to the PDP, Olusola Oke, to the effect that the court lacked jurisdiction to entertain the suit on the grounds that the election of a party’s leaders was an internal affair of the party.
